You own a large apartment complex with multiple units. Until now you have been renting them out, but you now want to sell them individually. To make this possible, you often need to cadastrally split the building. This means that one building is divided into multiple apartment rights, so that the units can be sold separately.

Selling an apartment building?

Want it handled quickly and properly? We guide you through the steps below. The steps for splitting into apartment rights:
 

  • Municipality and policy: In many cities a subdivision permit is required. We do the permit check and align with the municipality.
    Structural requirements: The building must be in good condition. Depending on the municipality, additional conditions apply.
  • Application procedure: We handle the subdivision permit application, including reports and subdivision drawings.
  • Deed of division and HOA: The notary draws up a deed of division. This is the moment the building is officially registered with the
  • Land Registry: the cadastral split. From that point, separate apartment rights exist and a Homeowners Association (HOA) is automatically established.

We guide the entire process: from the permit check with the municipality to preparing drawings and gathering the required documents. We submit the application and ensure the notary receives all paperwork. Your building is ultimately officially divided into apartment rights, so the units can be sold individually.

For this complex of over fifty apartments, we handled the entire subdivision process. The building had been rented out for many years and the owner decided to sell the units individually.
 

  • Challenge: the municipality of Groningen had to grant a subdivision permit. A key question was whether the building, with just one main connection for electricity and gas and sub-meters per apartment, was suitable for subdivision.
  • Solution: together with the building inspector we assessed the situation and aligned with the municipality. Retaining the main connection turned out to be permitted.
  • Approach: we produced a long-term maintenance plan and subdivision drawings, had a draft deed of division drawn up by the notary, and submitted the application.
  • Result: after approval, the notary cadastrally split the building and registered it with the Land Registry. The apartments could be sold as separate apartment rights.
